Welcome to World ADV Dispatch, a newsletter and website published by WaarMoto (waarmoto.com). These Terms of Use ("Terms") govern your access to and use of our website, newsletter, and related services (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services. Questions can be sent to [email protected].
Who we are WaarMoto is a brand operated by 2592133 Alberta Inc., a corporation registered in the Province of Alberta, Canada. WaarMoto shares stories, gear notes, route reports, and adventure motorcycling perspectives from Keith and Andrea Waara and the contributors we curate.Our Privacy Policy (available at waarmoto.com/privacy) explains how we handle personal information and forms part of these Terms.
You are at least 13 years of age; and
You can form a legally binding contract under the law of Alberta, Canada, or your parent or legal guardian agrees to these Terms on your behalf.
By using the Services, you represent that you meet these requirements. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
WaarMoto publishes news, opinion, gear reviews, and route information for adventure and dual-sport riders. Our content is for general informational and entertainment purposes only. They are not:
Riding, training, or safety instruction. Adventure motorcycling involves real physical risk, including injury, disability, and death. Nothing on waarmoto.com replaces professional rider training, official manufacturer guidance, or the judgment of a qualified instructor.
Mechanical, maintenance, or modification advice for your specific bike. Always follow your bike's owner's manual, manufacturer service bulletins, and the guidance of a licensed motorcycle mechanic.
Legal advice about riding, licensing, importing motorcycles, insurance, border crossings, or route legality in any jurisdiction.
Medical advice, including advice about fitness to ride, gear ergonomics, hydration, altitude, fatigue, or injury.
Financial or purchasing advice. Product mentions, gear reviews, and bike coverage reflect the opinions of the author at the time of writing, are subject to change, and are not recommendations to buy.
Route or trip planning services. Route reports, GPX links, and travel notes describe conditions at a specific time. Roads, borders, closures, permits, weather, and safety conditions change constantly. Verify current conditions with official sources before you ride.
Riding a motorcycle carries inherent risk. Always use your own judgment, wear proper protective equipment, and follow local laws.
By subscribing to World ADV Dispatch, you agree to receive periodic emails from us. By subscribing, you:
Confirm that the email address you provided is yours or that you have permission to use it;
Consent to receive commercial electronic messages from WaarMoto under Canada's Anti-Spam Legislation (CASL); and
Agree that we may use standard email delivery and engagement analytics (open, click, and bounce tracking) as described in our Privacy Policy.
You can unsubscribe at any time using the link at the bottom of any email we send, or by contacting us directly.
If we provide an account or subscriber login feature, and if you create an account:
Provide accurate, current information;
Keep your credentials confidential;
Notify us at [email protected] as soon as reasonably possible if you suspect unauthorized access;
Understand that you are responsible for activity on your account, subject to applicable law.
We may suspend or close accounts that violate these Terms, that show signs of abuse or fraud, or that have been inactive for an extended period.
If you submit content to WaarMoto — for example, comments, replies, ride reports, photos, videos, testimonials, feedback, questions, or ideas ("User Content") — you agree to the following.
You will not submit User Content that:
Is unlawful, defamatory, harassing, threatening, hateful, or discriminatory;
Infringes anyone's intellectual property, privacy, publicity, or contractual rights;
Contains malware, spam, phishing, or scraping tools;
Impersonates another person or misrepresents your affiliation with a person or organization;
Promotes illegal activity, dangerous riding of a kind that could reasonably encourage others to injure themselves or others, or activities that violate motor vehicle or trespass laws;
Contains sexual content involving minors, or any content that exploits or endangers a minor.
You retain ownership of the User Content you submit. By submitting User Content, you grant WaarMoto a worldwide, non-exclusive, royalty-free, sublicensable, transferable licence to use, host, store, reproduce, modify, adapt, publish, translate, distribute, and display that content in connection with operating and promoting the Services, in any media now known or later developed. This licence continues even if you stop using the Services, to the extent needed for archival, backup, or legal purposes. You represent that you have all rights necessary to grant this licence and that your User Content does not infringe or violate any third party's rights or applicable laws. You are solely responsible for your User Content.
We may, but are not obligated to, monitor, review, remove, or edit User Content at our discretion, without notice, for any reason including a suspected violation of these Terms.
The Services and their content — including text, graphics, logos, images, software, and design — are owned by WaarMoto or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may:
View, read, print, and share links to WaarMoto content for personal, non-commercial use;
Quote short excerpts with clear attribution and a link back to the source page on waarmoto.com;
Forward individual newsletter issues to friends for personal, non-commercial purposes.
You may not, without our prior written permission:
Copy, republish, mirror, or redistribute substantial portions of WaarMoto content;
Use WaarMoto content to train, fine-tune, or evaluate machine learning or AI models;
Scrape, harvest, or systematically collect content from the Services;
Use WaarMoto's names, logos, or trade dress in a way that suggests endorsement or affiliation;
Remove copyright, trade-mark, or attribution notices.
If you believe your copyright has been infringed by content on the Services, contact [email protected] with:
A description of the copyrighted work;
The location on the Services where the material appears;
Your contact information;
A statement, made in good faith, that you are the rights-holder or authorized to act on their behalf.
We will review and respond in a reasonable time.
You agree not to:
Use the Services in a way that violates any applicable law, regulation, or third-party right;
Interfere with, disrupt, or overload the Services or the infrastructure of our service providers;
Attempt to gain unauthorized access to any part of the Services, other users' accounts, or connected systems;
Reverse engineer, decompile, or extract source code from the Services except where such restriction is prohibited by law;
Use bots, scrapers, crawlers, or similar automated tools on the Services except for well-behaved indexing by mainstream search engines that respect our robots directives;
Send unsolicited commercial or bulk messages using contact information collected from the Services;
Use the Services to develop a competing product or dataset.
We may investigate suspected violations and take any action we consider appropriate, including removing content, suspending access, and cooperating with law enforcement.
The Services regularly link to third-party websites, videos (including YouTube), articles, product pages, blogs, forums, maps, and social media posts.
Those third-party services are not controlled by WaarMoto.
Their terms and privacy policies apply once you leave waarmoto.com or click a link in our emails.
We do not endorse, warrant, or take responsibility for the accuracy, safety, availability, or practices of any third-party service, even when we speak positively of them.
Prices, product availability, route conditions, weather, border rules, and other details linked from WaarMoto can change without notice. Verify with the source before making a purchase or a riding decision.
To the maximum extent permitted by law:
The Services and all content on them are provided "as is" and "as available," without any warranty of any kind — express, implied, or statutory. This includes warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, quiet enjoyment, or non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
We do not warrant that any information on the Services is accurate, current, complete, or suitable for your specific circumstances, including any decision you make about riding, gear, routes, purchases, training, or travel.
Adventure motorcycling is inherently dangerous. You accept full responsibility for assessing your own skills, equipment, health, and the conditions of any route or activity before you ride.
Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under Alberta law or the Consumer Protection Act (Alberta) or the Competition Act (Canada).
To the maximum extent permitted by law:
WaarMoto, 2592133 Alberta Inc., and our directors, officers, employees, contractors, and contributors are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of profits, revenue, data, goodwill, use of a motorcycle, riding time, or any personal injury or property damage — arising out of or related to your use of the Services or your reliance on any content, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or related to the Services will not exceed CAD $100 or the amount you have paid us in the 12 months before the event giving rise to the claim, whichever is greater.
These limitations apply whether the claim is based in contract, tort (including negligence), statute, or any other legal theory, and even if a remedy fails of its essential purpose.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence to the extent such liability cannot be excluded under Alberta law.
You agree to defend, indemnify, and hold harmless WaarMoto, 2592133 Alberta Inc., and our directors, officers, employees, contractors, and contributors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with:
Your use of the Services;
Your User Content;
Your breach of these Terms or any applicable law; or
Your violation of any third-party right.
We reserve the right to assume the exclusive defence and control of any matter subject to indemnification, in which case you agree to cooperate with our defence.
We may change, suspend, or discontinue any part of the Services at any time, with or without notice.
We may also update these Terms from time to time. When we make a material change, we will:
Update the "Last updated" date at the top of this page; and
Where reasonable, notify subscribers by email or through a notice on waarmoto.com.
Your continued use of the Services after a change takes effect means you accept the updated Terms. If you do not agree, stop using the Services and unsubscribe using the mechanisms in Section 4.
You can stop using the Services at any time and unsubscribe from the newsletter at any time.
We may suspend or terminate your access to all or part of the Services, without notice, if we reasonably believe you have violated these Terms, created legal or safety risk for us or others, or engaged in fraud or abuse.
The sections of these Terms that by their nature should survive termination will survive — including Sections 6.2 (licence to User Content), 7 (intellectual property), 10 (disclaimers), 11 (limitation of liability), 12 (indemnification), 15 (governing law), and 16 (dispute resolution).
These Terms and any dispute arising out of or in connection with them or the Services are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-laws principles.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before starting a formal legal proceeding, please contact us at [email protected] and try to resolve the issue with us informally. Most concerns can be sorted out this way.
If we cannot resolve a dispute informally, you and WaarMoto agree that the courts of the Province of Alberta, sitting in Calgary, Alberta, will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking urgent injunctive relief in any court of competent jurisdiction.
Entire agreement. These Terms, together with our Privacy Policy and any other notices or terms we post on the Services, are the entire agreement between you and WaarMoto about the Services and supersede any prior agreements about the same subject matter.
Severability. If any part of these Terms is found unenforceable, the rest will remain in effect, and the unenforceable part will be modified only to the minimum extent necessary to make it enforceable.
No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
Assignment. You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Notices. We may give you notice by email, by posting on waarmoto.com, or by any other reasonable means. You can send us notice at [email protected].
Language. These Terms are drafted in English. If we provide a translation, the English version controls in the event of any conflict, to the extent permitted by law.
No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and WaarMoto.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, civil disturbance, labour disputes, government action, internet or power outages, or failures of third-party service providers.
